A day after real
estate promoter Supertech moved Supreme Court against an Allahabad High Court
order directing that of its two towers be demolished, the Noida Authority too
filed a Special Leave Petition before the apex court.
On April 11, 2014 the
Allahabad High Court had ordered the demolition holding that the
under-construction towers, numbered 16 & 17, were being built in violation
of the UP Industrial Area Act and the UP Apartment Act.
In its order, a bench
of Justices Mr. V. K. Shukla and Mr. Suneet Kumar had slammed the role of the
Noida Authority & said the officials who gave sanction to the construction
be identified and prosecuted.
“Taking advantage of
the situation, the builder lobby is exploiting people’s needs by setting up
illegal construction and the unfortunate part of this is that it has active
assistance of the officers of the development authority…,” the Supreme Court
had said.
A Noida Authority
official said, “We have submitted to the Supreme Court that the Noida Authority
acted within the framework of regulations that it is meant to & there was
no wrongdoing at all.
” On Wednesday,
Supertech had appealed to the apex court, arguing that they had not been able
to put forth their case satisfactorily before the Allahabad High Court. “There
is no wrongdoing & the towers have come up after due clearances,” Mr. R K
Arora, CMD and MD of Supertech, had said.
