The Supreme Court stayed the demolition of Supertech’s two towers.
Chief Justice Mr. R.M Lodha issued a notice after hearing the petitions from the developer, Noida Authority and the house buyers.
Earlier, Supertech, Noida Authority and the home buyers of Apex and Ceyane, had filed a Special Leave petition in the Apex Court, challenging Allahabad High Court’s order to demolish the two high-rise structures which are in advanced state of construction with 31 floors already constructed in one of the tower.
On April 11, 2014 High Court justices Mr. V.K. Shukla & Mr. Suneet Kumar had ordered the demolition of the towers within a period of " 4 months" and ordered the builder to refund their money with "14% interest compounded annually".
The court also ordered appropriate action against Supertech and officials of the concerned Noida Authority, which gave a green signal.
This was after the members of Emerald Court Residential Welfare Association moved court challenging the height of the towers, which has been projected to reach 40 floors. The 2 towers are expected to have 857 apartments and of these more than 70% of the flats have already been. The towers are a part of Supertech's Emerald Court society in Sector 93-A.
In the petition, Supertech claimed that the two towers were being constructed as per “approved building plans” and “there is no violation”.
"We have filed an SLP (Special Leave Petition) in the Supreme Court," Supertech Chairman and Managing Director R K Arora had said.
"I think somewhere there was an error in the way we presented our case before the Honourable High Court. Maybe our point could not be laid out properly," Arora had told.
