If the builder fail to deliver the flat as per agreed time..


First thing, the time agreed to deliver the flat shall be known. If the builder fail to deliver the flat as per agreed time you can move consumer court for the deficiency in service & claim compensation including the interest paid by you to the housing loan.


Secondly, if you wish to terminate the agreement it will cause great hardship. since you already availed loan from home finance company / Bank, you can not terminate the agreement with the builder with out the knowledge of the housing loan bankers.


It is better issue notice to the builder stating the delay and the loss caused to you due to delay. Consult an advocate with relevant documents & act as per his/her advise.
