My Brother missed 15 years ago. We have common house Property, for family need, we want sale this property with signature of the brother. Is it Possible?

The house property can not be sold without the signature of the your brother because he is having equal right over the same.

The Indian law is that if a person is missing for more than 7 (Seven) years he is presumed to be dead. But, that can not be done on your own.



You have to file a civil (Court) suit praying for a declaration that the brother is presumed to be dead & produce in the said case documents such police complaint, Paper and Television advertisement, etc. to show that even after such steps the brother could not be traced.

Only after getting a judgment in the civil case, the property can be sold.
