Family of Computer Engineer Killed in 2008: Road Accident to Get Compensation Rs. 93 Lac..!


One of the Chennai city court has awarded Rs. 92.86 lakh compensation to the family of a computer engineer who was killed in a road accident on Old Mahabalipuram Road in April 2008.

Mr. Suresh Sundar (Age 30), was employed with a software major having its corporate office at Siruseri on the Old Mahabalipuram Road. On April 16, 2008, while he was on his way to his office from his Periyar Nagar residence, Mr. Sundar's bike was knocked down by a bus taking workers to a factory near Sriperumpudur. He was rushed to a hospital, where he died without responding to treatment.

Mr. Suresh Sundar left behind his parents, homemaker-wife Ms. Hanna Angelin and an  8 month-old son.

His wife, son and father Mr. Elumalai approached the court seeking a total compensation of Rs. 1.07 crore. At the time of his death, Mr. Sundar was drawing a salary of Rs. 84,279 per month, the court was informed.



Compensation Rs. 93 lakh..!

Passing orders on the matter on recenly, the chief judge of the small causes courts Chennai, Mr. Meenakshi Sundaram, awarded a compensation of Rs. 92.86 lakh. The figure was arrived at on the basis of Mr. Sundar's age, salary and his notional income in future, minus the day to day expenses required for his family. The 'multiplier formula', as it is called, yielded a figure of Rs. 92,86,832.

The judge said Mr. Sundar's wife shall get Rs. 40 lakh from the compensation, while the son would get Rs. 34.3 lakh. His father & mother would get  Rs. 8.56 lakh & Rs. 10 lakh respectively, the judge Mr. Meenakshi Sundaram said.

This is the second highest compensation awarded to the family of a road accident victim. Only last week, a lok adalat Chennai had awarded Rs. 1.68 crore compensation to the family of a software engineer who was killed in a road mishap in the city. The engineer, who was employed in Singapore and drawing a salary of nearly Rs. 1.87 lakh per month, was killed while on a visit to the Chennai city.

Suresh, Who specializes in accident claims, said, "Thanks to a series of judicial pronouncements, the road accident compensation regime has been rationalised now, with the sums being arrived with mathematical precision.  The multiplier formula gives a reasonable idea about the possible compensation package at the time of filing the claims petition itself"

He adding that only the percentage of interest and period of interest payment vary from case to case, and continue to be discretionary in nature.
