* A
recent directive by the department of town planning says that private
developers have to inform flat owners or investors about any change in layouts
of projects in Gurgaon.
* A welcome move, the
directive means that developers can not make changes affecting green zones
without owners know.
Plot
owners have objections shifting of green space or
/ open space in the project will not be
allowed..!
According to a recent
directive by the Department of Town and Country Planning (DTCP), private
developers / promoters will now have to inform flat owners or investors about
any change in the layout plan of the projects in Gurgaon.
The fresh direction
is sure to bring transparency in the manner in which the developers are
handling the projects.
Mandatory
for Developers..!
Now, it is not
mandatory for developers / promoters to share all the details of the layout
plan & the changes incorporated in projects.
Now the changes,
especially those linked to the green belt & open spaces, will not be
possible unless the developers have secured concurrence of the flat owners and
investors.
In case the plot
owners have objections then shifting of green space or / open space in the
project will not be allowed.
In Gurgaon there have
been instances in which the builders / developers have fiddled with the main
layout plan and shrunk green and open spaces in housing projects.
Avoiding
Inconvenience to Allottees and Flat Owners.!
The Gurgaon DTCP's
order will help in avoiding inconvenience to the allottees & flat owners
and also litigation. The new rules clearly stipulate that the builder shall
inform all the existing plot holders about the proposed layout plan being
revised through public notice in the newspaper with a request to submit in
writing any objection, within a period of 30 days (One Month) from the date of
intimation by the competent authority.
The developer /
promoter will have to make a copy of the earlier approved layout plan and the proposed
layout plan made available on the website, at the site office and also in the
office of the DTCP (Planning) in the district.
The developer shall
submit the report clearly indicating the petition, if any, received from
allottees and action taken thereof along with an undertaking to the effect that
the rights of the existing plot holders have not been infringed.
The DTCP rules
further stated that any allottee having any objection to the revised layout
plan, may file his objection in the office of the district town planner
concerned.
Shifting of Open
Space..!
The new policy will
cover group housing colonies and the allottees of the dwelling units shall
submit the objections, if any, to revision of building plans including site
plan.
Further, shifting of
open space / park / play area / tot-lots / green belt, if any, earmarked within
the approved site plan of the group housing colony will not be allowed in any
circumstance, says the order.
