The Supreme Court has
prohibited high courts from interfering in the sale of mortgaged property. In
the instant case, the owner of the property sold it & there was a resale too. With the result, the
high court cancelled the sale in favour of the purchaser from UPFC (Uttar
Pradesh Finance Corporation).
On appeal, the
Supreme Court ruled that the UPFC had the power to sell the mortgaged property
& courts should not interfere in such private sales of property.
