Real Estate company fined Rs. 1 lakh for Not allotting Space Promised

The Chandigarh Consumer Disputes Redressal Forum-I has directed a Chandigarh based real estate development firm to give compensation of Rs 50,000 each to 2 applicants, and also refund the money deposited by them, for not allotting them space at the FT (Fashion Technology) Park proposed by it at Sector 90 in Mohali.

President of the Forum Mr. P.D. Goel and Members Mr. Rajinder Singh Gill and Dr. Madanjit Kaur Sahota had also directed the company to pay Rs. 10,000 each as litigation costs to the 2 applicants.

The order was given by the Forum following the complaints filed by Mr. Meenakshi Tuli Pasrija, a resident of Sector 15 in Chandigarh and  Mr.Saloni Jain, a resident of Faridabad.

Mr. Meenakshi Tuli Pasrija and  Mr.Saloni Jain had separately applied for industrial work space / design studio in the proposed FT Park. Each of them had paid the required money to the company for the allotment. The allotment was to be made by mid-2009, but this was not done.

In January 2010, the company said it was willing to compensate the applicants and gave them the option of ‘buy back’. The company promised that the ‘buy back option’ would be honoured by December 2010, but this was not done.

Aggrieved by this, the applicants filed complaints in the Chandigarh Consumer Disputes Redressal Forum-I.

In its reply, the company claimed that construction work at the site was in full swing, and had been delayed due to global recession of 2008-09.

After considering the 2 cases, the Chandigarh Consumer Disputes Redressal Forum-I observed that the company did not pay Rs 7.50 lakh due to each applicant as part of the ‘buy back option.’ In this light, the Forum directed the company to pay Rs 7.50 lakh to each applicant, and also compensate them for the harassment and loss suffered by them.
